Every funnel needs three legal pages: Privacy Policy, Terms of Service, and Disclaimer. Learn how to create them in ClickFunnels and add proper consent language to your opt-in forms.
TL;DR: Every funnel that collects email addresses, runs ads, or sells anything needs three legal pages: a Privacy Policy, Terms of Service, and Disclaimer. This guide shows you how to create them as standalone pages in ClickFunnels, link them in your funnel footers, and add proper consent language to your opt-in forms. Skip this and you risk ad account shutdowns, FTC violations, and GDPR/CCPA penalties.
Nobody starts a business thinking about legal pages. You built your funnel, wrote your emails, and now you are ready to drive traffic. But before you turn on a single ad, you need three documents in place -- or you are putting your entire business at risk.
This is not fear-mongering. Here is what actually happens when you skip legal pages:
The good news: you can set this up in under an hour, and you only do it once. Here is exactly how.
What it covers: How you collect, use, store, and protect personal information.
Legally required when:
In practice, if you have a website or funnel with any form or tracking pixel, you need a Privacy Policy. Period.
What your Privacy Policy must include:
What it covers: The rules for using your website, funnel, and services.
What your Terms of Service must include:
What it covers: Manages expectations about results, especially important for coaches and consultants.
Legally required when:
The FTC requires that:
What your Disclaimer must include:
You have two options for where to host your legal pages:
If you have a main website outside of ClickFunnels, you can host the legal pages there and link to them from your funnel. This works but has a downside: visitors leave your funnel domain, which can cause tracking inconsistencies.
Recommendation: Host them on the same domain as your funnel so everything stays on one domain.
Every page in your funnel -- opt-in page, thank-you page, booking page, sales page -- needs footer links to all three legal pages.
Add this to the footer section of every funnel page in ClickFunnels:
```html
<div style="text-align: center; padding: 20px 0; font-size: 12px; color: #666;">
<p>
<a href="/privacy-policy" target="_blank" style="color: #666; text-decoration: underline;">Privacy Policy</a>
|
<a href="/terms-of-service" target="_blank" style="color: #666; text-decoration: underline;">Terms of Service</a>
|
<a href="/disclaimer" target="_blank" style="color: #666; text-decoration: underline;">Disclaimer</a>
</p>
</div>
```
In ClickFunnels:
If you have multiple funnels, create a saved section in ClickFunnels with the footer template. This way you can add it to new pages in one click and update it globally if your URLs change.
This is the step most people miss. Having legal pages is not enough -- you also need to inform users that by submitting the form, they are agreeing to your policies.
Bad: "Free. No spam. Unsubscribe anytime."
This is not consent language. It does not reference your Privacy Policy, it does not explain what you will do with their data, and "no spam" is subjective.
Add this text directly below your opt-in form, above the submit button, in small (10--12px) text:
> By submitting this form, you agree to receive marketing emails from Bezalel Digital. You can unsubscribe at any time. We respect your privacy. [View our Privacy Policy](/privacy-policy).
For GDPR compliance (if serving EU visitors), you also need an unchecked checkbox:
> [ ] I agree to receive marketing communications from Bezalel Digital and acknowledge that I have read the [Privacy Policy](/privacy-policy).
Key rules for consent language:
If your funnel includes testimonials, case studies, or any mention of results (revenue, leads, growth), add a disclaimer directly adjacent to each claim.
After each testimonial or case study, include:
> Results are not typical. [Name]'s results depended on [specific factors]. Your results will vary based on your effort, market conditions, and other factors. See our full [Disclaimer](/disclaimer).
At the bottom of any sales page or case study page:
> Results Disclaimer: The results and testimonials shown on this page are not typical and are not a guarantee of future performance. Individual results will vary based on effort, experience, market conditions, and many other factors. Please see our full [Earnings Disclaimer](/disclaimer) for details.
Meta requires a Privacy Policy link on any landing page used in ads. If your opt-in page does not have one, your ads may be rejected or your ad account may be restricted.
Checklist for Meta compliance:
Google requires:
Run through this before launching any funnel:
Yes. If you collect email addresses, use tracking pixels, or run paid ads, you need a Privacy Policy at minimum. Meta and Google both require a Privacy Policy on landing pages used in ad campaigns. Terms of Service and a Disclaimer protect you from liability.
Free generators create generic templates that may not cover your specific data practices, third-party integrations, or industry requirements. They are better than nothing, but for a real business, have a lawyer review your legal pages at least once. Budget $300--800 for a legal review.
Update them whenever you add a new tool, change your data practices, or modify your services. At minimum, review them quarterly. Always update the "Last Updated" date when making changes.
No. One Privacy Policy, one Terms of Service, and one Disclaimer can cover all your funnels as long as the documents accurately describe your data practices across all funnels. Link to the same three pages from every funnel.
Meta may reject your ads, restrict your ad account, or disable it entirely. Google may disapprove your ads. Even if ads run initially, policy enforcement can happen at any time and shut down your campaigns without warning.
ClickFunnels provides page templates but not legal document templates. You need to write (or have a lawyer write) the legal text yourself and then add it to the ClickFunnels pages.
